1. Welcome
Welcome to The Embodied Collective ("TEC").
We're so pleased you've chosen to be part of our community.
These Terms & Conditions outline the agreement between you and The Embodied Collective when you purchase or use
any of our memberships, products or services. They are designed to ensure we can provide a safe, supportive and
enjoyable coaching experience while protecting both you and our business.
By purchasing a membership, accessing our app, downloading our resources or using any service provided by The
Embodied Collective, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
If you have any questions about anything contained within this Agreement, please contact us before purchasing your
membership.
2. Definitions
Throughout these Terms & Conditions:
"The Embodied Collective", "TEC", "we", "our" or "us" refers to The Embodied Collective.
"Member", "you" or "your" refers to any individual who purchases or accesses a membership, product or service
provided by The Embodied Collective.
"Membership" refers to your active subscription with The Embodied Collective.
"Base Membership" refers to any recurring membership offered by The Embodied Collective, including (but not limited
to) Training & Nutrition, Nutrition Only and Training Only memberships.
"App" refers to the third-party platform used to deliver your coaching services, programs and resources.
3. Memberships & Services
The Embodied Collective provides online health and fitness coaching designed to help members build sustainable habits
through nutrition, training, education and accountability.
Depending on the membership selected, your membership may include:
• Custom workout programs
• Personalised nutrition targets
• Nutrition plans and recipe libraries
• Progress tracking tools
• Educational resources
• Habit tracking
• Community support
• Ongoing program updates
• Coaching support via email (support@theembodiedcollective.co.nz)
• Training and nutrition reviews
Membership inclusions vary depending on the membership selected and may change from time to time as we continue
improving our services.
The Embodied Collective reserves the right to update, improve, replace or remove membership features, educational
resources, recipes, workouts, nutrition resources and other content where reasonably required to improve the member
experience.
4. Membership Commitment & Renewals
The Embodied Collective memberships operate as recurring subscriptions.
By joining, you agree to the selected membership fee and billing frequency at the time of purchase (for example, weekly,
fortnightly or monthly, where available).
All Memberships require a minimum commitment of eight (8) weeks.
Following the completion of your minimum commitment period, your membership will automatically renew at your
selected billing frequency until cancelled in accordance with these Terms & Conditions.
It is your responsibility to ensure your payment details remain current throughout the duration of your membership.
No fixed-term contract applies after the minimum commitment period. Your membership simply continues on a recurring
basis until you choose to cancel.
5. Health & Medical Disclaimer
Your health and safety are our priority.
The information, coaching, workout programs, nutrition plans, recipes and educational resources provided by The
Embodied Collective are intended for general educational purposes only and are not intended to replace professional
medical advice, diagnosis or treatment.
Your personal meal plan is developed using recommended daily energy intake guidelines based on your height, weight,
age, activity level and sex. Nutritional information and ingredient data used within our meal plans are sourced from
recognised food composition databases, including the Food and Nutrition Database for Dietary Studies (FNDDS) and the
USDA National Nutrient Database for Standard Reference (SR). While every effort is made to provide accurate
nutritional information, values are estimates only and may vary depending on ingredient brands, preparation methods and
product variations.
Before beginning any nutrition or exercise program, you should consult your doctor or another suitably qualified
healthcare professional to determine whether participation is appropriate for your individual circumstances.
Participation in any exercise or nutrition program carries inherent risks, including illness, injury and, in rare
circumstances, serious medical events. By participating in our services, you acknowledge that you do so voluntarily and
accept full responsibility for your own health and wellbeing.
If at any stage you experience pain, dizziness, illness, injury or any concerning symptoms, you should stop participating
immediately and seek appropriate medical advice.
Pregnancy, Breastfeeding & Postpartum
Our memberships are designed for the general healthy population and are not specifically designed for pregnancy or
postpartum rehabilitation.
If you are pregnant, recently postpartum, breastfeeding or have any medical condition that may affect your ability to
safely participate, you must obtain appropriate medical clearance before using our services.
Where appropriate, we may make reasonable adjustments to your nutrition or training recommendations. However, it
remains your responsibility to ensure participation is suitable for your individual circumstances and to follow the advice
of your healthcare provider.
Medical Conditions
If you have an injury, illness, medical condition or physical limitation that may affect your participation, you are
responsible for informing The Embodied Collective where requested and obtaining appropriate medical advice before
participating.
The Embodied Collective accepts no responsibility for any injury, illness or health complication arising from
participation in our services where appropriate medical advice has not been obtained.
6. Coaching Scope
The Embodied Collective provides education, accountability and coaching in relation to health, nutrition and exercise.
Our services are not intended to diagnose, treat or cure any medical condition and should never replace advice provided
by your doctor, dietitian, psychologist or other registered healthcare professional.
Any decisions you make regarding your nutrition, exercise or lifestyle remain your own responsibility.
7. Risks of Participation
By participating in any membership, program or service provided by The Embodied Collective, you acknowledge that all
forms of exercise and nutrition involve an element of risk.
While we take every reasonable step to provide safe, evidence-based guidance, participation in any exercise or nutrition
program may result in injury, illness, discomfort, serious harm or, in rare circumstances, death.
You acknowledge that you participate voluntarily and accept full responsibility for your own health, safety and wellbeing
throughout your membership.
You agree to exercise within your own capabilities, use appropriate technique, and discontinue any activity that causes
pain, dizziness, discomfort or concern.
The Embodied Collective cannot guarantee that participation in our programs will be free from risk and accepts no
responsibility for injuries or health complications arising from participation, except where required under New Zealand
law.
8. Expected Results
Every member is different, and results will vary from person to person.
While our coaching is designed to support sustainable progress, we cannot guarantee any specific outcome, including
weight loss, fat loss, muscle gain, performance improvements or other physical changes.
Your results will depend on many factors, including but not limited to:
• Your consistency
• Your effort and adherence
• Your nutrition
• Your training
• Your sleep and recovery
• Stress levels
• Medical conditions
• Medications
• Genetics
• Lifestyle factors outside of our control
Testimonials, progress photos and success stories shared by The Embodied Collective represent the experiences of
individual members and should not be interpreted as typical or guaranteed results.
9. Member Responsibilities
As a member of The Embodied Collective, you agree to:
• Provide accurate information when completing questionnaires, check-ins and assessments.
• Notify us of any significant changes to your health, medical conditions, pregnancy status or medications that may
affect your participation.
• Communicate respectfully with our team and other members at all times.
• Complete workouts safely and within your own capabilities.
• Seek appropriate medical advice whenever required.
• Use the coaching, education and resources provided as guidance while accepting responsibility for your own
decisions and actions.
The Embodied Collective is committed to providing guidance, education and support throughout your membership.
However, your progress will ultimately depend on your own consistency and commitment.
10. Check-ins & Program Delivery
Our memberships are designed around regular program reviews to ensure your training and nutrition continue to support
your goals.
As a general guide:
• Nutrition reviews are completed approximately every four (4) weeks.
• Workout programs are updated approximately every eight (8) weeks.
Members are responsible for completing any required check-ins by the requested timeframe. Failure to submit a check-in,
progress information or other requested details may delay updates to your program.
New memberships, nutrition plans, workout programs and program updates are generally completed within 72 business
hours of receiving all required information.
While we always aim to meet this timeframe, delays may occasionally occur during weekends, public holidays or periods
of high demand.
11. Billing & Payments
Membership fees are billed automatically via Stripe using your selected payment method.
By purchasing a membership, you authorise The Embodied Collective to process recurring payments in accordance with
your selected membership and billing frequency until your membership is cancelled in accordance with these Terms &
Conditions.
You are responsible for ensuring your payment details remain current and that sufficient funds are available on your
nominated payment method.
If a payment is unsuccessful, we may attempt to process the payment again.
Continued failed payments may result in temporary suspension of your membership, including access to the app,
programs and member resources, until your account has been brought up to date.
Membership fees may be reviewed from time to time. Should your membership price change, we will provide at least 14
days' written notice before the new pricing takes effect.
Any applicable payment processing fees or transaction charges will be clearly communicated at the time of purchase.
12. Membership Changes
Members may request to upgrade their membership at any time (for example, moving from Training Only to Training &
Nutrition, or from Nutrition Only to Training & Nutrition).
Downgrades (for example, moving from Training & Nutrition to Training Only or Nutrition Only) are not available until
you have completed your minimum eight (8) week commitment. This ensures we're able to deliver the full value of your
selected membership, including any personalised programs already developed for you.
Please note that changing your membership may immediately affect your access to certain features, resources and
inclusions within the app.
Where applicable, any pricing adjustments will take effect from your next billing cycle unless otherwise advised.
Membership changes may also be restricted during active challenges or promotional periods — see Section 17
(Challenges & Promotions) for details.
The Embodied Collective reserves the right to make reasonable changes to membership inclusions, coaching processes,
educational resources, app functionality and service delivery where necessary to improve the member experience.
13. Legacy Pricing
From time to time, The Embodied Collective may offer promotional pricing, introductory offers or special membership
rates.
If you cancel your membership, any promotional, discounted or grandfathered pricing attached to your account will be
forfeited.
Should you choose to rejoin The Embodied Collective at a later date, your membership will be charged at the current
advertised price available at the time of rejoining.
Legacy pricing cannot be reinstated once a membership has been cancelled.
14. Cancellation Policy
Following the completion of your minimum eight (8) week commitment, you may cancel your membership at any time.
To cancel your membership, written notice must be provided by emailing support@theembodiedcollective.co.nz at least
seven (7) days before your next scheduled billing date.
If sufficient notice is not provided, your next scheduled payment will still be processed and your membership will remain
active until the end of that billing period.
Membership cancellations must be submitted via email. Cancellation requests made through social media, text message
or other communication channels may not be accepted.
Cancelling your membership will result in the removal of access to your training programs, nutrition plans, recipes,
educational resources, community content and all other membership benefits at the conclusion of your paid membership
period.
15. Pause Policy
The Embodied Collective understands that life happens. Holidays, family commitments, illness and other personal
circumstances may mean you need to temporarily step away from your membership.
Once you have completed your minimum eight (8) week commitment, you may request one (1) membership pause per
calendar year.
Your annual pause may be for one (1), two (2), three (3) or four (4) consecutive weeks, with a maximum total pause
allowance of four (4) weeks per calendar year.
Pause requests must be submitted by emailing support@theembodiedcollective.co.nz.
Unlike membership cancellations, no minimum notice period is required. Once eligible, your pause can commence from
the day your request is received.
During your pause period:
• Recurring membership payments will be temporarily suspended.
• Access to the app will be removed.
• Access to your workout programs, nutrition plans, recipes, educational resources and member content will be
unavailable.
• Nutrition and training check-ins will be paused.
• Community support provided as part of your membership may also be unavailable during your pause period.
Your membership will automatically resume once your selected pause period has ended, and recurring payments will
recommence accordingly.
Pause periods cannot be backdated and cannot be split across multiple occasions within the same calendar year.
16. Refund Policy
Due to the digital nature of our memberships and the immediate access provided to personalised programs, educational
resources and member content, all membership fees and subscription payments are non-refundable except where required
under the Consumer Guarantees Act 1993 or any other applicable New Zealand legislation.
Choosing not to use your membership, failing to complete check-ins, illness, injury, pregnancy, changes in personal
circumstances or a change of mind does not entitle you to a refund.
If you experience circumstances that affect your ability to participate, please contact us as soon as possible. Where
appropriate, we may recommend suitable program modifications or discuss your eligibility for a membership pause.
17. Challenges & Promotions
From time to time, The Embodied Collective may run challenges, promotions or special campaigns.
Participation in these events may be subject to additional terms and conditions specific to that promotion.
Unless otherwise stated, members participating in an active challenge may not upgrade or downgrade their membership
until the challenge has concluded.
Promotional pricing applies only to the membership selected at the time of purchase and cannot be transferred to another
membership type.
All promotional pricing remains subject to the standard minimum commitment period unless otherwise stated.
The Embodied Collective reserves the right to modify, extend, withdraw or cancel promotions or challenges at any time.
18. Intellectual Property
All programs, workout plans, nutrition plans, recipes, educational resources, videos, graphics, documents, templates,
branding, logos, downloads and other content provided by The Embodied Collective remain the intellectual property of
The Embodied Collective.
Your membership provides you with a personal, non-transferable licence to use these materials for your own individual
use only.
You must not copy, reproduce, distribute, sell, publish, share, modify or commercially exploit any material provided by
The Embodied Collective without prior written permission.
Unauthorised sharing or distribution of membership content may result in immediate termination of your membership
without refund and may result in further legal action where appropriate.
19. Membership Sharing
Memberships are issued to one individual only and are non-transferable.
You must not share your account, login details, workout programs, nutrition plans or other membership resources with
any other person.
The Embodied Collective reserves the right to suspend or terminate memberships where account sharing or unauthorised
use is identified.
20. Photos & Testimonials
From time to time, members may choose to share progress photos, testimonials, reviews or other feedback with The
Embodied Collective.
By voluntarily providing this content, you grant The Embodied Collective permission to use it for marketing, educational
and promotional purposes across our website, social media platforms and other marketing channels.
If at any time you no longer wish for your images or testimonial to be used, simply notify us in writing and we will
remove future use wherever reasonably possible.
The Embodied Collective will never knowingly share your progress photos without your consent.
21. Privacy
Your privacy is important to us.
The Embodied Collective is committed to protecting your personal information and handling it in accordance with
applicable New Zealand privacy laws.
By becoming a member, you consent to The Embodied Collective collecting, storing and using your personal information
for the purpose of delivering your membership, communicating with you, processing payments and improving our
services.
We will only collect information that is reasonably necessary to provide our services, including but not limited to:
• Contact details
• Health and lifestyle information you choose to provide
• Progress photos and measurements
• Nutrition and training information
• Payment and billing information
• Membership activity within the app
Your personal information will never be sold to third parties.
We may share information with trusted third-party service providers where necessary to deliver your membership (such
as payment processors or our app provider). These providers are required to protect your information in accordance with
their own privacy obligations.
You may request access to, correction of or deletion of your personal information at any time, subject to any legal
obligations requiring us to retain certain records.
22. Third-Party Services
The Embodied Collective uses trusted third-party platforms and software providers to deliver aspects of our services,
including membership management, payment processing, communication and app functionality.
While we carefully select these providers, we are not responsible for temporary outages, technical issues, software bugs,
maintenance periods or interruptions that are outside of our reasonable control.
Where third-party issues affect your membership experience, we will always do our best to communicate updates and
resolve the situation as quickly as possible.
23. Cookies & Online Advertising
Our website may use cookies and similar tracking technologies to improve your browsing experience and, where
applicable, to support advertising through third-party platforms such as Google.
Cookies may be used to remember your preferences or to serve relevant advertising based on your previous visits to our
website.
You can manage or disable cookies at any time through your browser settings.
For more information on how Google uses data for advertising purposes, you can visit Google's Privacy & Terms page.
24. Communication
By becoming a member, you agree to receive communications relating to your membership, including emails regarding
your account, billing, program updates, check-ins and important membership information.
With your consent, we may also send occasional educational content, promotions, special offers or updates about new
products and services.
You may unsubscribe from marketing emails at any time using the unsubscribe link included in those communications.
Please note that opting out of marketing emails will not prevent us from sending important service-related
communications regarding your membership.
Members are expected to communicate respectfully with The Embodied Collective team and other members at all times.
Abusive, threatening, discriminatory, harassing or inappropriate behaviour towards staff or members will not be tolerated
and may result in immediate suspension or termination of your membership without refund.
You acknowledge that your results and progress remain your own responsibility, and that outcomes may vary based on
the factors outlined in Section 8 (Expected Results). You agree not to make any defamatory, false or misleading
statements about The Embodied Collective, whether publicly or privately, including on social media, review platforms or
any other communication channel. This does not limit your right to provide honest feedback directly to us or to exercise
any rights you may have under the Fair Trading Act 1986 or the Consumer Guarantees Act 1993.
25. Limitation of Liability
To the fullest extent permitted by New Zealand law, The Embodied Collective will not be liable for any direct, indirect,
incidental or consequential loss, injury, damage or expense arising from your participation in our memberships, programs
or services.
This includes, but is not limited to:
• Injury or death sustained while exercising
• Illness or health complications
• Loss of income
• Loss of data
• Technical issues relating to third-party software
• Failure to achieve desired results
Nothing within these Terms & Conditions excludes or limits any rights you may have under the Consumer Guarantees
Act 1993, the Fair Trading Act 1986 or any other legislation that cannot legally be excluded.
26. Suspension or Termination of Membership
The Embodied Collective reserves the right to suspend or terminate a membership immediately where a member:
• Breaches these Terms & Conditions.
• Shares membership content or account access without permission.
• Fails to maintain required membership payments.
• Behaves in a manner that is abusive, threatening, discriminatory or inappropriate towards staff or other members.
• Engages in conduct that may damage the reputation of The Embodied Collective or negatively impact the
experience of other members.
Where a membership is terminated due to a breach of these Terms & Conditions, no refund will be provided.
27. Changes to these Terms & Conditions
The Embodied Collective may update these Terms & Conditions from time to time to reflect changes to our
memberships, services, business operations or legal obligations.
Where changes materially affect your membership, we will provide reasonable notice by email, within the app or via
another appropriate communication channel.
Your continued use of your membership after any updated Terms & Conditions come into effect constitutes acceptance
of those changes.
28. General Terms
If any provision within these Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining
provisions will continue in full force and effect.
Any failure by The Embodied Collective to enforce a provision of these Terms & Conditions does not constitute a waiver
of that provision or any other rights available to us.
These Terms & Conditions are governed by the laws of New Zealand, and any disputes arising from this Agreement will
be subject to the exclusive jurisdiction of the New Zealand courts.
29. Acceptance of Terms & Conditions
By purchasing or continuing a membership with The Embodied Collective, you acknowledge and agree that:
• You have read, understood and agree to these Terms & Conditions.
• You understand the minimum commitment period applicable to your membership.
• You understand your billing obligations, cancellation policy and pause policy.
• You understand that results cannot be guaranteed and that your progress depends on many factors, including your
own consistency and effort.
• You acknowledge the risks associated with participating in exercise and nutrition programs, including the risk of
injury or death.
• You accept responsibility for seeking appropriate medical advice where required.
• You agree to communicate honestly, respectfully and promptly throughout your membership.
• You agree not to share, reproduce or distribute any membership content without written permission.
• You agree not to make defamatory, false or misleading statements about The Embodied Collective.
• You understand that membership inclusions may evolve over time as The Embodied Collective continues to
improve its services.
• You acknowledge that promotional or legacy pricing will be forfeited if your membership is cancelled.
• You understand that your membership is personal to you and may not be transferred or shared.
• You agree to comply with these Terms & Conditions throughout the duration of your membership.
